These are the terms you agree to when you use annanursery.shop or buy a plant from us. We've written them to be readable — not 40 pages of fine print nobody reads. If anything's unclear, WhatsApp us.

1. About us

These Terms of Service ("Terms") govern your use of annanursery.shop (the "Site") and your purchase of any products or services from Anna Nursery ("we", "us", "our").

We are a plant nursery based in Mumbai, Maharashtra, India, in operation since 2010. Our registered business details are:

Simple version: You agree to these terms when you use the site or buy a plant. They're written to be fair and easy to follow. Disputes, if any, go to Mumbai courts.

2. Acceptance of terms

By browsing the Site, creating an account, placing an order, or joining the Care Club, you confirm that:

  • You are at least 18 years old, or are accessing the Site under the supervision of a parent or guardian
  • You have read and agree to these Terms and our Privacy Policy
  • The information you provide to us is accurate and complete
  • You will use the Site only for lawful purposes

If you do not agree, please do not use the Site.

3. Accounts

You may be able to create an account on the Site to place orders, track shipments, or join the Care Club. If you do:

  • You are responsible for keeping your login details secure
  • You are responsible for all activity that happens under your account
  • You agree to tell us right away if you suspect unauthorised access
  • You may delete your account anytime by WhatsApping us — we will process it within 7 business days

4. Orders & pricing

All prices are displayed in Indian Rupees (₹) and are inclusive of GST where applicable, unless otherwise stated. Pot accessories, care kits, and shipping may be priced separately.

  • Prices may change without prior notice, but any order placed at a confirmed price will be honoured at that price
  • Product photos are representative — because plants are living things, the one you receive will be similar in size and character, but not identical to the photo
  • We reserve the right to refuse or cancel orders if there is a pricing error, a stock shortage, a delivery limitation in your pin code, or a suspected fraudulent order. If we cancel, we refund in full within 7 business days
  • Orders are considered confirmed only after we send you a confirmation message (email or WhatsApp) with an order number starting with "AN-"

5. Payment

We accept payment through secure third-party payment gateways (e.g. Razorpay). Supported methods include credit and debit cards, UPI, net banking, and select wallets.

  • We do not store card numbers, UPI IDs, or CVVs on our servers — all payment data is handled by the payment gateway under their PCI-DSS compliant systems
  • Payment is processed at the time of checkout. Your order is only reserved once payment is confirmed
  • In case of payment failure, please contact us on WhatsApp before retrying — so we don't accidentally charge you twice

6. Shipping

Shipping terms, timelines, coverage, and weather-related pauses are detailed in our Shipping Policy, which is part of these Terms.

In short: we dispatch Monday through Thursday, deliver in 3–7 days across Indian cities, offer free shipping on orders over ₹999, and pause shipments during extreme weather to protect the plants.

7. Returns & refunds

Our return and refund terms — including our Alive-on-Arrival promise and 30-day replacement policy — are detailed in our Refund & Returns Policy, which is part of these Terms.

In short: if your plant arrives damaged or dies within 30 days, WhatsApp us a photo within 48 hours and we'll replace it or refund you — with a simple process and typically no return shipping fees.

8. About the plants

You are purchasing living things. Please understand:

  • Variations are normal. Leaves may differ in size, pattern, or number. Every plant is one of a kind
  • Some cosmetic imperfections are expected. Small blemishes, one or two damaged leaves from shipping, minor soil spillage — these are normal and not grounds for replacement
  • Plants need ongoing care. We provide detailed care guides and one month of free WhatsApp support. Beyond that, the plant's survival depends on your care
  • Some plants are toxic to pets or children. We flag this clearly on every product page. Please read before ordering if you have cats, dogs, or young children at home
  • We cannot guarantee flowering, fruiting, or growth rate. These depend on conditions we can't control once the plant leaves our beds

9. User conduct

When you use our site or interact with us, please don't:

  • Attempt to hack, crash, or reverse-engineer any part of the site
  • Use automated scripts, scrapers, or bots to access the site
  • Upload viruses, malware, or any malicious code
  • Impersonate other people or businesses
  • Use our WhatsApp support for abuse, harassment, or repeated non-plant-related spam
  • Resell our products as if you were an authorised reseller without written permission

Violations may result in your account being terminated and, in serious cases, legal action.

10. Our content

The site, our product photos, our written content (care guides, journal articles, product descriptions), our logo, and our name are our intellectual property. You may:

  • Share a link to any page on the site
  • Share a photo of a plant you bought with credit to @annanursery on social media
  • Quote short excerpts (under 100 words) from our journal with a link back

You may not copy our product descriptions, care guides, photos, or journal articles for use on another commercial website without written permission. We actively monitor for copying and will enforce this.

11. Liability

We take care to provide accurate information and healthy plants. However, to the maximum extent permitted by Indian law:

  • Our total liability for any order is limited to the amount you paid for that order
  • We are not liable for indirect or consequential losses (for example, if a plant dies, we're responsible for replacing the plant — not for the hours you spent caring for it)
  • We are not liable for damage caused by incorrect use of a plant — e.g. if a child or pet ingests a toxic plant despite our clear toxicity warnings
  • Our plant care advice is informational, not professional horticultural consultancy. Use it as a guide, not gospel

Nothing in these Terms limits liabilities that cannot be excluded under Indian law, including the Consumer Protection Act, 2019.

12. Termination

We may suspend or terminate your access to the site or your account if:

  • You violate these Terms
  • We suspect fraudulent activity
  • We are required to do so by law

You may stop using the site anytime. If you want to delete your account and associated data, WhatsApp us.

13. Disputes

If you have a complaint or concern, please contact us first — we almost always sort things out with a WhatsApp conversation. If we can't resolve it informally:

  • You may escalate to our Grievance Officer (details below) — we respond within 48 hours and aim to resolve within 30 days
  • You may also use the Indian government's Consumer Helpline (1915) or file a complaint on the National Consumer Helpline Portal

These Terms are governed by the laws of India. Any disputes that cannot be resolved through the above processes shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.

14. Changes to these terms

We may update these Terms from time to time. We'll update the "Last updated" date at the top. If changes are material — for example, changes to returns or liability — we'll email registered customers and post a banner on the site. Your continued use of the site after an update means you accept the updated Terms.
